1. HOW THIS RELATES TO ODIX

ODIX offers the Euro Virtual IBAN under its agreement with the Account Partner. The Account Partner provides the euro account, the IBAN and the payment services, so its documents apply to you when you use them. ODIX gives you access through the ODIX Pay App and remains the company you contact for support.

The Account Partner's General Terms are the agreement for the euro account and payment services. The main points that affect you are reflected in Part F.

2. SERVICES

The Account Partner offers personal and business accounts, incoming and outgoing transfers in various currencies including SEPA and SWIFT, e-wallet services, card payments and ATM withdrawals. By accepting its terms, you also accept its Rules for Using Payment Cards, Rules on Investigation of Complaints, Privacy Policy and Acceptable Use Policy.

3. REGISTRATION AND SECURITY

Clients are onboarded remotely and must provide correct and complete information, and report changes within one business day. The Account Partner may request further information and suspend registration if it is not provided. Two-factor authentication must be activated within three days, or the account may be suspended.

4. ELECTRONIC MONEY

Money in the account is electronic money issued at face value when the Account Partner receives your funds. It is not a deposit, earns no interest and can be redeemed at face value at any time, subject to the usual transfer fees. The Account Partner may decide not to open, or to close, an account without giving a reason.

5. PAYMENTS

You can send money to other users of the Account Partner and to bank and payment accounts in the EU and abroad, except to prohibited countries. Exchange rates are shown before conversion.

Euro payments within the EU/EEA reach the recipient's provider by the end of the next business day; euro credit transfers within the Account Partner's country of establishment received before 12:00 on a business day are credited the same day. Non-euro EEA currencies may take up to four business days. These limits do not apply outside the EU/EEA, where details are incorrect, or during AML checks.

A payment order cannot be cancelled once execution has started. If you give a wrong account number, the payment is treated as properly executed and you should contact the recipient; the Account Partner will trace it on request and may charge a recovery fee. Returned payments are credited back, but fees are not refunded.

The Account Partner may refuse an order if it doubts that it was authorised or legitimate, may ask for proof of the source of funds, and may use intermediary institutions. Money credited by mistake must be reported within one business day and may be debited.

6. PRICING

Standard fees are published by the Account Partner, and individually agreed pricing takes priority. The Account Partner gives 60 days' notice of pricing changes, and you may terminate free of charge before they take effect. Fees are generally non-refundable, apart from the unused part of a monthly fee paid in advance.

7. PROHIBITED ACTIONS

Providing false information, refusing to provide information, moving illegally obtained money, illegal gambling, trade in weapons, drugs or prescription medicine, pornography, unlicensed lotteries and providing financial services without the Account Partner's consent are all prohibited.

8. CHANGES AND TERMINATION

The Account Partner notifies changes to its terms 60 business days in advance, and you may terminate free of charge before they apply. You may terminate with 30 days' notice. The Account Partner may terminate with 60 days' notice, or immediately for serious reasons such as material breach, false information, suspected financial crime or legal requirements.

9. SUSPENSION

The Account Partner may suspend a payment instrument or payment services where justified and proportionate, for example for security reasons, suspected fraud or unlawful use, sanctions or legal requirements, and will tell you unless the law prevents it.

10. LIABILITY AND REFUNDS

The Account Partner is liable for direct, proven damage caused by its breach, but not for indirect losses. Consumers bear up to EUR 50 of losses from unauthorised payments before reporting them, unless they acted fraudulently or with gross negligence. Unauthorised transactions must be reported within 13 months and are refunded by the end of the next business day unless fraud is suspected. Late or failed outgoing payments are refunded and the balance restored, unless the details given were incorrect.

11. SAFEGUARDING, LAW AND COMPLAINTS

The Account Partner holds client funds in a segregated account with an EU credit institution, separate from its own money. The terms are governed by the law of the Account Partner's EU country of establishment. Complaints are handled under the Account Partner's Rules on Investigation of Complaints.

12. FULL DOCUMENT AND QUESTIONS

You can read the complete Terms and Conditions of the Account Partner in the Account Partner's full document, made available to you in the App before you accept it and on request from support@odixpay.com. The Account Partner may update it; the version it currently publishes is the current one.
