C. ODIX Kartla Yatırma

PART C — ODIX DEPOSIT BY CARD

This Part C applies when you use ODIX Deposit by Card in the ODIX Pay App. It must be read together with the General Terms and our Terms & Conditions. Words with capital letters have the meanings given in the General Terms.

Important: ODIX makes Deposit by Card available in the App, but the service itself is provided entirely by our card-purchase partner, a licensed on/off-ramp partner (the "Card Purchase Partner"). When you use it, you enter into a separate agreement with the Card Purchase Partner, and the Card Purchase Partner — not ODIX — processes your card payment, carries out the exchange and delivers the Digital Assets.

2. WHO PROVIDES THE SERVICE

2.1 Deposit by Card is provided by the Card Purchase Partner. Depending on where you live, the service may be provided by a different company in the Card Purchase Partner's group. The company of the Card Purchase Partner's group that provides your order is the one named in the Card Purchase Partner's terms you accept at checkout.

2.2 For customers in the United Kingdom and the European Economic Area, the provider is a company of the Card Purchase Partner's group established in the European Union, which is authorised by its national competent authority in the EU as a crypto-asset service provider under the EU Markets in Crypto-Assets Regulation (MiCA) and as a payment institution under the EU Payment Services Directive (PSD2).

2.3 ODIX confirms that it offers Deposit by Card to you in the App and that the Card Purchase Partner is the provider of the service. ODIX is not a party to your agreement with the Card Purchase Partner, does not act as the Card Purchase Partner's agent for receiving your money, and does not hold your card payment at any time.

3. YOUR AGREEMENT WITH THE CARD PURCHASE PARTNER

3.1 Before your first deposit, the Card Purchase Partner will ask you to accept its own terms. Your order is governed by those terms, and they prevail over this Part C in any matter relating to the service the Card Purchase Partner provides. Each document of the Card Purchase Partner has its own page in this Legal centre (C.1 to C.6), with a summary and an explanation of how it relates to ODIX:

(a) Terms of Service: C.1 Terms of Service — summary and how it relates to ODIX (full text: shown at checkout before you accept it and available on request from support@odixpay.com)

(b) Privacy Policy: C.2 Privacy Policy — summary and how it relates to ODIX (full text: shown at checkout before you accept it and available on request from support@odixpay.com)

(c) Refund Policy: C.3 Refund Policy — summary and how it relates to ODIX (full text: shown at checkout before you accept it and available on request from support@odixpay.com)

(d) Pricing Policy: C.4 Pricing Policy — summary and how it relates to ODIX (full text: shown at checkout before you accept it and available on request from support@odixpay.com)

(e) Complaints Policy: C.5 Complaints Policy — summary and how it relates to ODIX (full text: shown at checkout before you accept it and available on request from support@odixpay.com)

(f) Conflict of Interest Policy: C.6 Conflict of Interest Policy — summary and how it relates to ODIX (full text: shown at checkout before you accept it and available on request from support@odixpay.com)

3.2 The Card Purchase Partner may change its terms and policies from time to time. Please read them before each deposit. The summary in this Part C is for convenience only and does not replace the Card Purchase Partner's terms.

4. ELIGIBILITY AND VERIFICATION

4.1 Under the Card Purchase Partner's terms, you must be at least 18 years old (or the age of majority where you live, if higher), you must not live in a jurisdiction where the Card Purchase Partner does not offer its services, and you must not be subject to sanctions.

4.2 The Card Purchase Partner carries out its own customer due diligence, which may include identity verification, enhanced checks and multi-factor authentication. The Card Purchase Partner may ask you for information or documents even if you have already completed verification with ODIX, and it may refuse or cancel an order if its checks are not completed.

4.3 You must also continue to meet the eligibility requirements of the General Terms. Deposit by Card is not available in every country.

5. PAYING WITH YOUR CARD

5.1 You may only use a card that is in your own name. Payments from cards belonging to other people are not allowed.

5.2 Your card payment is processed by the Card Purchase Partner and its payment partners. Your card issuer may treat the payment as a purchase or as a cash advance and may charge its own fees or interest. These charges are set by your card issuer and are not controlled by the Card Purchase Partner or ODIX.

5.3 Before you confirm, the Card Purchase Partner shows you the amount you will pay, the amount of Digital Assets you will receive, the exchange rate and its fees. A quoted rate is valid only for the period shown at checkout. Network fees are set by the relevant blockchain and may change until the transfer is executed.

6. DELIVERY TO YOUR ODIX WALLET

6.1 When your order is complete, the Card Purchase Partner sends the Digital Assets to the address of your ODIX Wallet. Delivery times depend on the Card Purchase Partner's checks and on the blockchain network.

6.2 Transfers of Digital Assets are generally irreversible once confirmed on the blockchain. Once the Digital Assets have reached your ODIX Wallet, they are held under the General Terms and Part A.

7. CANCELLATIONS, REFUNDS AND CHARGEBACKS

7.1 Refunds are handled by the Card Purchase Partner under its Refund Policy. In summary, a refund is generally available only where the Card Purchase Partner does not deliver the Digital Assets in line with your order. Once the Digital Assets have been delivered, the order cannot be refunded.

7.2 The Card Purchase Partner may cancel or reverse an order for good reason, for example because of a technical error, failed checks or suspected abuse. Any costs of a refund may be deducted from the amount refunded.

7.3 If there is a problem with a card payment, please contact the Card Purchase Partner before you raise a chargeback with your card issuer. The Card Purchase Partner may suspend your account with the Card Purchase Partner and hold funds while it investigates a chargeback.

7.4 ODIX cannot cancel, reverse or refund a Deposit by Card order.

8. RISKS

8.1 The value of Digital Assets can go up or down, and you could lose all the money you use to buy them. Do not buy Digital Assets unless you are prepared to lose that money.

8.2 Digital Assets bought through Deposit by Card are not bank deposits and may not be covered by any deposit guarantee, investor compensation or similar protection scheme.

8.3 Nothing in the App, on the Site or in this Part C is investment, financial, tax or legal advice.

9. COMPLAINTS

9.1 Complaints about a card payment, an exchange, a quote, a refund or the delivery of Digital Assets should be sent to the Card Purchase Partner through the complaints channel shown at checkout, or via support@odixpay.com. The Card Purchase Partner aims to respond within fifteen (15) business days, as set out in its Complaints Policy.

9.2 Complaints about the ODIX Pay App, your ODIX Wallet or the way Deposit by Card is shown in the App should be sent to us at support@odixpay.com.

10. OUR RESPONSIBILITY

10.1 Because the Card Purchase Partner provides the service, ODIX is not responsible for the Card Purchase Partner's acts or omissions, including declined payments, delays, quotes, fees, cancellations or refunds, except where we have caused the loss ourselves or where the law does not allow this to be excluded.

10.2 We may suspend, limit or withdraw Deposit by Card at any time, for example if our arrangement with the Card Purchase Partner ends or if required by law, a regulator or our risk assessment.
